разгледа докладваното от съдия С.П. <b style='mso-bidi-font-weight:normal'>дело
№ 11 по описа за 2009 година на гражданско отделение на съда</b>, намира
следното: </p>
<p class=MsoBodyText style='margin-right:17.7pt;text-indent:27.0pt'>Производството
е образувано по жалба на Ю.Х.К. чрез пълномощника му адвокат В.Я. срещу
действията на държавен съдебен изпълнител /ДСИ/ Анна Новакова, изразяващи се в постановено
определение за отказ да прекрати изпълнителното производство по изпълнително
дело № 20083130400077. С жалбата се претендира отмяна на това действие на ДСИ,
тъй като дължимата сума е изплатена. Излага, че определената от съда сума в
размер на 7 000 лева следва да бъде приета като абсолютен размер към
датата на извършеното деяние, която поради влизането в сила на Закона за
деноминацията на лева на 05.07.1999 г. следва да бъде определена на 7 лева
главница и 24,14 лева лихви. На 06.11.2008 г. длъжниците са превели по сметка
на ДСИ сумата от 62 лева, поради което и задължението е погасено.</p>
<p class=MsoBodyText style='margin-right:17.7pt;text-indent:27.0pt'>Срещу
жалбата е постъпило писмено възражение, в което се излага, че същата е
неоснователна. Развиват се съображения, че изпълнителният лист е издаден за
сумата от 7 000 лева, от което е видно, че става въпрос за деноминирани
лева.</p>
<p class=MsoBodyText style='margin-right:17.7pt;text-indent:27.0pt'>ДСИ излага
в обясненията си, че изпълнителният лист е издаден за сумата от 7 000
лева, поради което е налице частично изпълнение до размера на сумата от 62
лева.</p>
<p class=MsoBodyText style='margin-right:17.7pt;text-indent:27.0pt'><o:p> </o:p></p>
<p class=MsoBodyText style='margin-right:17.7pt;text-indent:27.0pt'>Жалбата е
подадена в преклузивния срок за обжалване на действието на ДСИ, поради което
същата е допустима и следва да бъде разгледана по същество.</p>
<p class=MsoBodyText style='margin-right:17.7pt;text-indent:27.0pt'><o:p> </o:p></p>
<p class=MsoBodyText style='margin-right:17.7pt;text-indent:27.0pt'>Съдът
съобрази, че изпълнителното дело е образувано въз основа на изпълнителен лист
от 18.06.2008 г., издаден по НОХД № 481/2006 г. на Районен съд - Провадия, с
който Х.К.Х. и <span class=SpellE>жалбоподателят</span> Ю.Х.К. са осъдени да
заплатят на взискателя К.А.К. сумата от 7 000 лева, представляваща обезщетение
за причинените с деянието неимуществени вреди ведно със законната лихва,
считано от датата на увреждането – 13.04.1994 г.</p>
<p class=MsoBodyText style='margin-right:17.7pt;text-indent:27.0pt'>В
действията си по принудителното събиране на сумата съдебният изпълнител следва
да се ръководи от изпълнителния лист, тъй като той материализира изпълнителното
основание. Не е в компетенциите на съдебния изпълнител да тълкува съдебният
акт, както правилно е отбелязано в обясненията на ДСИ Новакова. </p>
<p class=MsoBodyText style='margin-right:17.7pt;text-indent:27.0pt'>Изложените
в жалбата съображения за <span class=SpellE>недължимостта</span> на сумата се
явяват такива, относими към определението за издаване на изпълнителният лист,
които жалбоподателят е следвало да <span class=SpellE>релевира</span> с частна
жалба против определението за издаване на изпълнителен лист, което той не е
сторил в предвидения за това законов срок.</p>
